Protect the unique visual appearance of your product under the Designs Act, 2000

Design Registration

Design registration gives you the exclusive right to apply a new and original design to your product and take legal action against copying. Our IP attorneys handle end-to-end filing with the Patent Office (Design Wing).

What is Design Registration?

Design Registration in India is governed by the Designs Act, 2000 and protects the visual features of a product — its shape, configuration, pattern, ornamentation, or composition of lines and colours. A registered design gives the owner a 10-year exclusive right (extendable by 5 years) to apply that design to articles in the relevant class. It is a powerful tool against knock-offs and imitations of product aesthetics.

Frequently asked questions

What can be registered as a design?

Any new and original design applied to an article — such as shape, configuration, pattern, ornamentation, or composition of lines and colours — can be registered. The design must be applied to a finished article and must be visible in the final product.

How long does design protection last?

Initial registration is valid for 10 years from the registration date. It can be extended by a further 5 years on payment of the prescribed fee, giving a maximum of 15 years of protection.

What is the difference between design registration and copyright?

Copyright protects creative expression (art, literature, software) automatically on creation. Design registration protects the aesthetic appearance of industrial articles and requires a formal application. Once a design is registered, copyright in that design ceases to apply (Section 15 of the Copyright Act).

Can I register a design that has already been published?

No. A design must be novel and not previously disclosed to the public before the filing date. Any prior publication, display, or sale of the design will disqualify it from registration.

Does design registration protect me against competitors copying my product?

Yes. Registration gives you the exclusive right to apply the design to articles in the relevant class. You can seek an injunction, damages, and legal costs against infringers in court.
